License Categories
Colorado's MED issues licenses across several categories. The state uses an open licensing model — there is no cap on the number of licenses in any category, though local jurisdictions may impose their own limits.
Key License Requirements
- Background checks: All owners, officers, and key employees undergo fingerprint-based background investigations.
- Financial disclosures: Full disclosure of funding sources and ownership interests.
- Local approval: Must obtain local government approval before the MED will process a state application.
- Operating plan: Detailed plans for security, inventory management, waste disposal, and quality control.
- Metrc enrollment: All licensees must use the Metrc seed-to-sale tracking system.
Newer License Categories
Marijuana Hospitality (Consumption Lounges)
Authorized in 2019 via HB 19-1230, hospitality licenses allow businesses to operate cannabis consumption lounges. Requirements include local opt-in, HVAC ventilation standards, buffer zones from schools and other sensitive uses, and prohibition on co-location with liquor licenses. Denver is currently the primary market, with three licensed venues.
Delivery Permits
Also authorized in 2019, delivery permits allow licensed dispensaries to deliver cannabis products directly to consumers. Delivery requires local opt-in and is available in select municipalities. Deliveries must be made by employees who are at least 21 and hold a valid MED employee badge.
Section 280E: The Federal Tax Burden
Because cannabis remains federally illegal, cannabis businesses cannot deduct most ordinary business expenses under IRS Section 280E. This effectively increases tax rates by 60–80% compared to comparable non-cannabis businesses. Federal rescheduling (expected mid-2026) would eliminate 280E, potentially transforming profitability across the industry.
